Terms of Use and Privacy Policy
The following are the terms of use and privacy policy of the website www.30900.com (hereinafter: the "Site"). This policy applies to all genders and is written in the masculine form for convenience only.
The Barel Group respects the privacy of its clients, regards the protection of user privacy as important, is committed to safeguarding the personal information users share on the Site, and acts in accordance with the provisions of the law and the privacy policy set out below.
Entering or using the Site constitutes consent to this privacy policy, including to the collection, management, processing and storage of information as described herein. A user who does not agree to these terms must immediately refrain from any further entry to or use of the Site.
The following categories of personal information may be collected, stored, processed and used:
1. Device information — information about your computer, including your IP address, your location, your browser type and version, and your operating system;
2. User behaviour information — your visits to and use of the Site, including referral source, length of visit, page views and your navigation paths through the Site;
3. Information, such as your email address, that you enter when registering on our Site;
4. Information, such as your name and email address, that you enter in order to subscribe to our email updates and/or newsletter;
5. Information that you enter knowingly and of your own free will while using the services on our Site (contacting us, listing a property, receiving a service, joining a mailing list). Such information may include personal details such as full name, contact details (mobile telephone and email), residential address and identity card number;
6. Information that you enter while using the virtual assistant (chat) operating on the Site, as detailed in the "Virtual Assistant (Chat)" section below.
1. Cookies
In order to operate the Site — including for the purpose of collecting information about a user's use of the Site, verifying a user's identity in a service or in information on the Site, enabling more convenient and easier use of the Site, analysing and adapting the Site to the user's needs and preferences, and for information security purposes — the Site uses and/or will use "Cookies".
Cookies are small text files stored by the Site's servers, via the browser, on the hard drive of the computer being used. Cookies do not contain information that personally identifies the user; however, they do include data regarding the user's activity on the Site across a wide range of aspects. The use of cookies allows the Site to provide the user with a fast and efficient service, enables the collection of statistical data about use of the Site, and saves the user from having to enter their personal details again in future. A user may choose, by changing the settings of the browser they are using, to refuse to accept and store such cookies.
Most cookies can be disabled. Most internet browsers allow a user to delete cookies from their device, to block the receipt of cookies, or to receive an alert before cookies are stored. It is clarified, however, that deleting cookies from the browser or from the user's platform memory will not delete information and content that has already been transmitted on the Site. Users are advised to consult the instructions available in their browser or on its "Help" screen to learn more about these functions.
2. Virtual Assistant (Chat)
The Site operates a virtual assistant (the "Chat") based on artificial intelligence technology, which helps users find properties and obtain information about the Group's services. Responses in the Chat are generated automatically by a computerised system and not by a human representative, unless expressly stated otherwise during the conversation. Use of the Chat is optional and is not a condition for using the Site or receiving a service; a user who prefers a human response is welcome to contact us by telephone or through the contact page.
2.1 Information collected in the Chat
In the course of using the Chat, the following will be collected and stored:
1. The content of the messages entered by the user and of the responses provided to them (the conversation transcript);
2. The search criteria derived from those messages, such as town or neighbourhood, property type, price range, number of rooms and size;
3. The properties presented to the user during the conversation and the actions taken in relation to them;
4. Technical data and a conversation identifier, as set out at the beginning of this policy;
5. Where the user chooses to provide them so that we may follow up — contact details, including name and mobile telephone and/or email address.
Providing information in the Chat is done at the user's free will and there is no legal obligation to provide it. Sensitive information must not be entered into the Chat, including identity card numbers, bank account or credit card details, medical information, detailed financial information, or information concerning third parties.
2.2 Purposes for which the information is used
Information collected in the Chat will be used for the following purposes: responding to the user's enquiry and presenting relevant properties; transferring the enquiry to an agent on behalf of the Group for further handling and follow-up contact; improving service quality, identifying faults, and aggregate statistical analysis of search patterns (in a form that does not identify individual users); and complying with legal requirements.
2.3 Processing by a third-party provider and transfer of information outside Israel
The Chat is operated using the artificial intelligence services of Google Cloud (Vertex AI). Message content is transferred to this provider for the purpose of generating a response, and processing may take place on servers located outside the borders of the State of Israel. Such transfer is carried out in accordance with the provisions of the law applicable to the transfer of information abroad. Under the provider's terms of service, conversation content is not used to train its general models.
2.4 Retention period
Chat conversation transcripts are retained for a period of [365] days from the end of the conversation, after which they are deleted or anonymised so that the user can no longer be identified. Contact details provided for the purpose of further handling of an enquiry are retained for a period of [365], in each case subject to the user's right to request their deletion as set out below.
2.5 Marketing and promotional messages
Providing contact details in the Chat in order to receive a response to a specific enquiry does not constitute consent to receive advertising material. Advertising material, including by email, SMS or WhatsApp message, will be sent only after the user's express, separate and prior consent has been obtained, in accordance with Section 30A of the Communications (Telecommunications and Broadcasting) Law, 5742-1982. A user may notify us at any time of their refusal to receive advertising material, in the manner specified in each message or by contacting us.
2.6 Reliability of Chat responses
Responses in the Chat are generated automatically and may contain inaccuracies, omissions or information that is not up to date. Property details presented in the Chat — including price, size, number of rooms and availability — do not constitute a binding offer and should not be relied upon for decision-making. The binding details are those appearing on the property page on the Site and as confirmed by an agent on behalf of the Group. Information provided in the Chat does not constitute professional advice of any kind, including legal, tax, financial or valuation advice.
2.7 User rights and how to contact us
A user may request to review their conversation transcript, to correct it, to delete it, or to request that their conversations not be retained. Requests of this kind, and any question regarding the operation of the Chat, should be directed to [email protected], or by telephone on +97246399954, or via the contact page on the Site. We will handle your request within a reasonable time and in accordance with the provisions of the law.
3. Disclaimer of Liability
Use of the Site by the user is at the user's sole risk. Under no circumstances will the Site or any other party involved in creating, producing or supplying the Site be liable for any damage of any kind, including but not limited to direct, incidental, consequential, indirect or punitive damages, or damages arising from loss of profits, loss of data or business interruption, arising from the user's access to, use of, or inability to access or use the Site. This limitation of liability also applies to any damage or virus that may affect the user's computer equipment.
The owners do not warrant or undertake that files available for download from this Site will be free from contamination by viruses, worms, Trojan horses or other code having harmful or destructive properties.
The digital assets, including the services offered within them, may include links to various platforms (such as pages, websites, applications and the like) on the internet that are not operated or managed by the Group, including to the activities and services offered by them. The Group does not control or supervise the operation of such platforms, and linking to them via the digital assets does not indicate the Group's agreement with their content, nor does it guarantee their reliability, currency or legality; any use of them is the sole responsibility of the users. Use of such platforms is subject solely to the terms of use and privacy policies appearing on them, to the extent such exist, and users are therefore advised to review those documents before making any use of such platforms.
4. Access to Personal Information
Subject to the provisions of the law, users have the right to review identifiable personal information held and stored about them on the Site, and to request that it be corrected or deleted, to the extent they find that the information is incorrect, incomplete or not up to date. Users wishing to exercise these rights may contact the Group using the contact methods appearing on the Site below, and the Barel Group will make reasonable efforts to comply with such requests, in accordance with the provisions of the law.
5. Information Security
Reasonable efforts have been invested in the digital assets to maintain information security, including through technological mechanisms and systems intended to help protect against data leakage, unauthorised access and use, and against the transfer, disclosure, copying and deletion of information. However, while these efforts serve to reduce existing risks, it cannot be guaranteed that the digital assets will be entirely immune to such actions, and no liability will be accepted for any damage caused to users or anyone on their behalf as a result.
Users are aware that there is always a degree of risk in services based on information processing, particularly when information is transmitted over the internet, and they consent to the provision and collection of information in accordance with this privacy policy and the law, and assume the risk of information security incidents affecting the confidentiality, integrity or availability of such information.
6. Changes to the Privacy Policy
The provisions of this privacy policy may change from time to time, including in order to reflect regulatory, technological or business changes. Changes will be updated by publishing a new version on our Site. You should check this page from time to time to ensure that you understand any change made to this policy. 7. AI-Based Visualization
7.1 Nature of the Service
The site allows users to create visual renderings using artificial intelligence technologies, based on property images displayed on the site and on selections or descriptions made by the user. The user is aware that the AI system may generate elements, structures, materials, furniture, openings, views, or other details that do not exist in the actual property and that are not based on real data.
The renderings are intended for visual illustration, inspiration, and assistance in forming a design or marketing direction only. They are not to be regarded as an architectural plan, building plan, technical specification, measurement, binding rendering, professional opinion, factual representation, or undertaking of any kind.
7.2 Inaccuracies and Non-Reliance
The rendering may include inaccuracies, alterations, additions, omissions, or details that do not actually exist in the property, including dimensions, openings, internal layout, materials, furniture, garden, views, lighting, infrastructure, costs, building rights, permits, or feasibility of execution.
The rendering must not be relied upon for the purposes of purchase, sale, rental, investment, pricing, obtaining financing, planning, construction work, renovation, or any other professional or financial decision. Before making any decision, the actual data should be verified and qualified professionals consulted as needed. In addition, the user is solely responsible for any use made of the rendering, including its publication, presentation to third parties, or reliance upon it. Any decision based on the rendering is made at the user's sole responsibility.
7.3 No Warranty of Outcome or Correspondence to Reality
The site, its operators, and anyone acting on their behalf do not warrant that the rendering result will be accurate, complete, available, error-free, or consistent with a possible future outcome at the property. The service is based on artificial intelligence systems operated by third parties or by the site operator. By their nature, such systems may produce results that are inaccurate, inconsistent, or unpredictable, and the result is not to be regarded as factual information.
Every rendering is a computer-generated creation based on input data and automated processes. The actual outcome of designing, renovating, building, furnishing, or marketing a property may differ materially.
7.4 Rights in the Images
The images on which the renderings are based are displayed on the site under the responsibility of the site operator. Users do not upload images to the system and do not acquire any right in the source images or in the site's content, beyond the personal right to use the service in accordance with the terms of use. The site operator may add to the rendering a marking, watermark, or caption such as "AI-generated rendering" or "For illustration purposes only," and the user undertakes not to remove them.
The source images and the renderings created may not be copied, saved, distributed, published, edited, or used commercially without prior written approval from the site operator or the relevant rights holder.
7.5 Privacy
Users are requested not to enter into the system's free-text fields any personal, sensitive, or identifying information that is not required for the purpose of generating the rendering.
7.6 Limitation of Liability
Subject to any law that cannot be contracted out of, the site operator shall not be liable for any direct or indirect damage, financial loss, loss of profit, reliance on a rendering, transaction decision, or third-party claim arising from use of the service or from the result generated through it.
7.7 Prohibited Use
The service may not be used to create misleading content, forgery, impersonation, invasion of privacy, deception of buyers or tenants, advertising that does not correspond to the actual condition of the property, or content presented as though it were a real photograph of the property or a professional design, and/or for any unlawful use.
The site operator may update, modify, restrict, or discontinue the rendering service, in whole or in part, at any time and without prior notice.
Any publication in which a rendering is used must clearly state: "Rendering for illustration purposes only."
